1. Acceptance of Terms

By downloading, installing, or using the Shamia & Shuwaikh Cooperative Society mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

  • You must be at least 18 years old to create an account and use this App.
  • You must be a resident of Kuwait or have a valid Kuwait Civil ID to access certain features (membership, shareholder services).
  • By creating an account, you represent that all information provided is accurate and truthful.

3. Account Registration & Security

  • To access most features, you must register an account using your Kuwait Civil ID number and create a password.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • Accounts will be locked after 5 consecutive failed login attempts for a period of 30 minutes.

4. Services Provided

The App provides the following services:

4.1 Shopping & Orders

  • Browse products and categories from cooperative stores
  • Place orders for home delivery or pickup
  • Track order status in real-time
  • View order history and reorder

4.2 Digital Wallet

  • Top up your wallet using KNET, Visa, or Mastercard
  • Make payments using wallet balance
  • View transaction history
  • Earn and redeem loyalty points

4.3 Membership Services

  • Digital membership card with barcode and QR code
  • Member benefits and discounts
  • Family card management for dependents

4.4 Shareholder Services

  • View share holdings and investment details
  • Track dividend distributions and profit history
  • Manage profit withdrawal preferences (bank transfer or wallet)
  • Manage heir designations
  • Access to shareholder social news and communications

4.5 Facility Bookings

  • Book cooperative facilities (halls, meeting rooms, etc.)
  • Manage bookings and view availability

4.6 Price Checker

  • Scan product barcodes to check prices
  • View product details and availability

4.7 Branch Locator

  • Find cooperative branches on a map
  • View branch details, hours, and contact information

5. Payments & Transactions

  • All payments are processed through secure payment gateways (KNET, Visa, Mastercard).
  • Prices are displayed in Kuwaiti Dinars (KWD).
  • The cooperative reserves the right to modify prices without prior notice.
  • Refunds will be processed according to the cooperative's refund policy and may take up to 14 business days.
  • Wallet balances are non-transferable and non-refundable except as required by law.

6. Delivery

  • Delivery is available in designated areas within Kuwait.
  • Delivery times are estimates and not guaranteed.
  • The cooperative is not responsible for delays caused by circumstances beyond our control.
  • You must provide accurate delivery address information.
  • Minimum order values may apply for delivery services.

7. Intellectual Property

  • All content in the App, including but not limited to text, graphics, logos, images, and software, is the property of Shamia & Shuwaikh Cooperative Society or its licensors.
  • You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
  • The Shamia & Shuwaikh Cooperative Society name, logo, and branding are registered trademarks.

8. User Conduct

You agree NOT to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality
  • Upload or transmit harmful content (viruses, malware, etc.)
  • Impersonate another person or misrepresent your identity
  • Use the App to send spam or unsolicited communications
  • Reverse engineer, decompile, or disassemble any part of the App

9. Content & Social Features

  • The App includes social features where shareholders can post content, comments, and participate in discussions.
  • You are solely responsible for content you post.
  • We reserve the right to remove any content that violates these Terms or is deemed inappropriate.
  • You grant us a non-exclusive license to display content you post within the App.

10. Account Deletion

  • You may request account deletion at any time through the App's Settings screen or by contacting us.
  • Upon deletion, your personal data will be removed within 30 days, except for records required by law.
  • Financial transaction records may be retained for up to 7 years per Kuwait regulations.
  • Account deletion is permanent and cannot be reversed after the processing period.

11. Limitation of Liability

  • The App is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted or error-free service.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
  • Our total liability shall not exceed the amount paid by you through the App in the last 12 months.

12. Indemnification

You agree to indemnify and hold harmless Shamia & Shuwaikh Cooperative Society, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Kuwait. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kuwait.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of material changes through the App.
